TERMS OF SALES

  1. Preamble : The reservation is made directly between the customer and the owner. The customer declares to have obtained all the necessary information on the site where the reservation took place. Any booking through the website requires consultation and acceptance of these terms and conditions. The customer's agreement regarding these general terms and conditions occurs during the booking; no reservation is possible without this agreement. The customer has the ability to save and edit these terms and conditions using the standard features of his browser or computer. The site mentions the following information: the legal notice allowing a precise identification of the seller and indicating its name, the address where it is established, its e-mail address, its telephone number, its head office, if it is subjected to value-added tax and identified by an individual number its individual identification number, the Member State in which it was granted; the essential characteristics of the services offered; the prices; payment terms; the general conditions of sale; the period of validity of the offer and the price of it; the minimum duration of the proposed contract, if any. The customer, prior to the order of the services declares that the reservation of these services is carried out for his personal needs. All information available on the site is presented in French as well as possibly in several other foreign languages. The customer declares to have full legal capacity to engage under these terms and conditions.
  2. Definitions: In what follows, the terms below have the following meaning: "acknowledgment of receipt": email sent to the customer summarizing the reservation made by the customer and confirming receipt by the seller. "client": a natural person acting for his personal or professional needs but unrelated to the tourist activity. "electronic mail" means any message, in the form of text, voice, sound or image, sent by a public communication network, stored on a network server or in the recipient's terminal equipment, until that the latter retrieves it. "online reservation": booking of nights via the dematerialized booking voucher on the website. "service": booking of nights whose essential characteristics are presented on the website.
  3. Purpose:These general conditions define the rights and obligations of the parties in connection with the remote reservation of services offered by the seller on its website. They govern all the steps necessary for the reservation and the follow-up of the reservation between the contracting parties. The customer acknowledges having read and accepted these general conditions of sale available on the seller's website.
  4. Scope: These general terms and conditions apply to all bookings concluded via the internet.
  5. Duration: These general conditions of sale apply throughout the duration of online services by the seller on its website. The seller reserves the right, without notice or compensation, to close temporarily or permanently his website or the online booking space. The seller is not liable for damages of any kind that may result from these changes and / or temporary unavailability or the permanent closure of all or part of the site or related services, such as the online booking area.
  6. Booking :The client chooses the services presented on the site. The customer acknowledges having read the nature, destination and booking conditions of the services available on the website and have requested and obtained necessary and / or additional information to make his reservation with full knowledge of the facts. The customer is solely responsible for his choice of services and their suitability for his needs, so that the responsibility of the seller can not be sought in this regard. The reservation is acknowledged as accepted by the customer at the end of the booking process. The reservation is deemed to consist of online payment by credit card. The customer undertakes, prior to any reservation, to complete the information requested on the voucher or reservation request.   8. Cancellation or modification due to the customer: The customer is reminded, in accordance with Article L. 121-20-4 of the Consumer Code, that he does not have the right of withdrawal as provided for in Article L. 121-20 of the Consumer Code, provided that the services are provided on a specific date or period. The conditions of cancellation or modification are indicated in the sales conditions attached to each tariff, if applicable. Non cancellable offers: The customer cannot claim any refund. Payment is charged at the time of booking. Cancellations: In case of cancellation, a percentage of the total amount of the reservation will be charged to the guest card as follows Cancellation more than 30 days before arrival: 10%, 30 to 21 days before arrival: 40% , 20 to 8 days before arrival: 60%, 7 to 2 days before arrival: 75%, 1 day before arrival: 100%. In case of interruption of the stay, the entire agreed price will be cashed. In case of no show (reservation not cancelled - customer not present), the customer will not be able to claim any refund. Unless expressly stated otherwise, the guest must vacate the room by 11.00 am the day of the end of the reservation. Otherwise, he will be charged an additional night.
  9. Responsibility: While every effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate the destination presented give as accurate an overview as possible of the services offered, variations may occur, in particular because of the change of furniture or possible renovations. The customer cannot claim any claim for this fact, since these variations do not relate to the essential characteristics of the service. The seller cannot be held responsible for the non-performance or improper performance of the reservation in case of force majeure, by a third party, the customer or his partners, such as unavailability of the Internet, impossibility access to the website, external intrusion, computer viruses. In the case of exceptional events or force majeure, the seller reserves the right to partially or fully accommodate customers in a local establishment at no extra charge. In case of force majeure, unforeseeable events or beyond his control, the seller must inform the customer by all possible means to limit potential damage.
  10. Claims: claims relating to non-performance or improper performance must, on penalty of foreclosure, be brought to the attention of the seller by writing within 24 hours of arrival.
  11. Prices: The prices indicated are per room for the number of people and the date (s) selected. The prices are displayed in amount inclusive of VAT, in euros, and are valid only for the duration indicated on the site. Rates and conditions are subject to change without notice depending on business conditions and requirements. Unless otherwise stated, additional services are not included in the price. The tourist tax, collected by the municipality is fixed by the latter and is payable directly to the seller on the spot, except in the case where this amount can be included in the selling price. The prices include the VAT applicable on the day of the order and any change of the rate applicable to the VAT will be automatically passed on the indicated prices. The prices do not include the commission according to the means of payment used. American Express 2.95%, as well as other cards outside the European Union.
  12. Respect of private life : The information which is requested to the customer is necessary to the processing of his order and will be communicated to all the speakers and partners. In the absence of information, the seller will not be able to book a reservation. Unless the customer objects to it, if the customer has made a reservation on the website, the seller is likely to send him by e-mail, promotional offers, a satisfaction questionnaire following his stay. The customer has the option to oppose, at no cost, that the data concerning him are used for purposes of prospection, and more particularly commercial. The customer is informed, on each form of personal data collection, the mandatory or optional nature of the responses by the presence of an asterisk.
  13. Agreement of proof : The acceptance of these general conditions and the request for reservation constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.
  14. Applicable law: The present general conditions of sale are governed by the French law, it is thus for the rules of substance as for the rules of form.
  15. Completeness: The present general conditions of sale express the entirety of the obligations of the parties. No general or specific condition communicated by the customer will be able to integrate with the present general conditions. The documents forming the contractual commitments between the parties are, in order of increasing priority, the reservation request (including the special conditions of the reserved fare) and these general conditions.
